I think as scitunes would probably also speak to is that copyright even affects educators under the fair use statute.
You definitely have to be careful nowadays; especially with the number of companies willing to throw indies under the bus (look at what PlayFirst did just a couple of weeks ago to Beebe Games over the "Dash" TM). Get in a companies way to make money or potentially tarnish their brand and they'll do you in. You can't afford that as an indie.
Anyways, I hope you are able to get onside with copyright and the like and that your next game is original, and successful.

Obviously I did not change the game enough for people around here to be comfortable with.
