I woke up this morning to find that my new game Alpha Sniper is finally in the app store.

I actually decided to run a quick test for a few days and see how it works out. The game is free until the 6th, so feel free to pick it up and review

Yes that game was my inspiration and reference point for this, but if you look at my images I re-did them myself (even things like the bullets in the corner)
If I took an image of Mario and changed it, so it was no longer "Mario" it would be completely fine to use. This is what I had done here.
If you guys do not like my justification then so be it, but those are my reasons and i will have to live with any consequences that may arise, even though there will be no issue.
Im just saying, if game making is something you keep persuing, where you try to build a portifiol and reputation, this will haunt you forever.
I will say this, I do understand where you are coming from, but it was my decision. If it makes any of you feel better, the game was made free early Monday morning with the release of my update before any of this hit the forum.
I have much more to say about this topic, but its not really relevant at the moment so I will keep it to myself.

1) Bottom bar is different between the two games.
2) Scope is defiantly not the same, idk how you even came up with that one.
3) Character is the "Same", but like I said I could have re-colored Mario called him Lario and put him in and it would be fine.

This is a more low profile situation, I doubt anything will come of it, but come on dude you totally lifted it.
Even if you redid the graphics.
I can't take the movie script from Titanic, use different actors with a different wardrobe, and call it my movie.
You can be sued if there are enough points of similarity between 'Lario' and 'Mario', for instance, for people to associate Nintendo's brand with your own.
Which would clearly happen here with Lario. You've made superficial modifications to Mario. People *would* associate the Nintendo character with your own as they're ostensibly the same.
Sure, it's easier to get away with it with more obscure stuff. But there will ALWAYS be someone out there who will think 'Oooh! I know where that's from!' unless it's original.
You've been caught out - and though this isn't quite 'duck hunt kid' levels, it's still copyright infringement and there's no real getting away from that.
I know most people will assume you're a 'kid' that doesn't understand/care about these kinds of laws. Perhaps you are. But If you're of any age, be it teenager or 'distinguished elder', PLEASE understand this:
It is NOT ok to take the work of others, modify it slightly and profit from it as though it were your own without the express permission of the person that made the image/sounds.
No excuses are gonna get you round that.

Here it is, Red Block Remover. As you all know this is one of TSB games. To my knowledge he has made a pretty penny off this one, enough to make a sequel. In case none of you noticed, this game was "copied" from an online flash game called Red Remover. Now idk how many of you have played both games, but I have and to my surprise they are extremely similar. Almost to the point of similarity between my game and the other.
Dont believe me? Lets take a look at the first few levels of both games.

Now it looks to me like I have "copied" to the same extent as TSB here, but go ahead and say what you will about my game and process of making it. All I am asking here is for equality. If you guys are going to badger me for what I have done then have the balls to say something to TSB about it as well. Just because you "value" him more and are possibly afraid that you might make him leave the forum you all keep your mouth shut.
Like I said, I have no issue with TSB at all, this is just too perfect of an example here of the same situation but from different perspectives. Kinda like a celebrity only getting 30 days in jail for a crime a normal civilian would get 2-5 years.
I am just dying to hear anyones half ass excuse to badger me and not TSB.

Like stated before with the arrival of my update this past Monday morning the game was made free, way before any of this mess appeared on the forum.
I think everyone already knew that Red Block Remover is a clone of Red Remover, and I dont think TshirtBooth has ever denied that, or said anything to the contrary.
So yes...hes taken the game idea and done a similar game, and yes some would argue a copy...
But where things are different is that he hasnt taken the original games artwork, recoloured it, and then tried to resell it as his own. What part of copyright dont you understand?
What part of using someone elses assets, modifying them slightly, and then selling them as your own dont you understand to be wrong?
So yes... TshirtBooths game is a clone/copy of another game, and some will frown on even that... but its a totally different degree of copying that were talking about between his and your game.
Trying to cover your wrongdoings by trying to drag someone else through the mud is a cheap attempt at turning the attention away from yourself.
Honestly, instead of wasting time on excuses, or trying to badmouth others, its just easier to admit to yourself and others what you did wrong... change it... then move on... and work on repairing your reputation with future honest behaviour.
Really.. its not that hard....
Here's the thing, copyright law is about intellectual property but you CANNOT copyright ideas. You can only copyright intellectual property that is in some "permanent form." So if I get up at an open mic night and make up lyrics on the spot, sing them out loud, and someone else rights my lyrics down. THEY now own the copyright because they were the first to put it into permanent form. Even though they were my IDEAS. Had I written down the lyrics ahead of time I could sue the guy and win. So what TSB and others (myself included as mentioned above) have done is taken ideas (that CANNOT be copyrighted) and have made our OWN graphics, sounds, level layouts, etc.
So having a game where you remove certain colored objects and not others is an IDEA - free to be used by others
using a slingshot to knock down structures and take out enemies is an IDEA - free to be used by others
An image of a girl holding a gun is a permanent piece of intellectual property and is Copyrighted the moment it is made in a permanent form (i.e. the moment the original artist made the file on his/her computer).
You have clearly taken this intellectual property and have not modified more than 70%, so therefore you have stolen the IP under current copyright law.
Again, ideas cannot be copyrighted. Intellectual Property such as written words, images, recorded sounds, or anything else that is in a some permanent form is copyrighted the instant it is made permanent. (The whole library of congress thing is just a way to make a formal record of the copyright).
