I'm not a fan of Star Wars or action figures but can respect the cats that like it. Theirs some neat figures out there. Did you happen to see Pawn Stars a few nights ago? Some guy brought in 4-5 original Series 1 Star Wars action figures. One was super rare because it was a Jawa (sp?) that had a variant cape only released for like 2 weeks. It was crazy.
ANYWAY, as for your app. Looks really cool. It's nice to see someone use GameSalad for something other than a runner
I Don't think this project will get you rich... just not enough collectors... But something tells me this is more a labor of love than trying to buy a new Jetski.
As for Disney or lucasfilm lawyers, the app falls under the "fair use" doctrine since it is a reference app. It's the same as publishing a walk through guide for a game or an unauthorized biography.
Yeah, I don't think you have any trademark violations. I wouldn't be worried about that. I don't think they'd really care either. You're not trying to profit off the Lucas/Disney brand and that's really what gets the lawyers moving.
I am a big fan, just watched the making of (the ones told by R2D2 and C3PO) today. I have an r2d2 and c3po from back when the original movies where running in the Netherlands but I am having doubts if they are the real deal. I believe I also have a Ben and Darth somewhere but I am sure the capes are gone.
LOL, I used to collect StarWars toys did for years started off as a hobby ended up as insanity going to stores everyday and midnight madness at toys'r us before the new movies would come out crazy, I finally had enough and sold every thing off years ago. My collection filled up a room and a half in my house I think I have pictures somewhere.
I cannot wait for this. Had a huge collection at one point. Used to get wizard magazine and it had a checklist so you could keep track of your collection and see the value of the characters and if you had special rare versions and things.
Really nice looking app.... Between us, me and my older brother pretty much had most of the Star wars figures and vehicles from the first time around... Back in the late 70s and early 80s so your app is a real walk down memory lane.
I do think that your app will receive the wrath of the LucasArt/Disney/Kenner lawyers though, and your understanding of fair use is a little off and somewhat naive. Your app trades on likenesses, assets and logos owned by someone else... And just happens to be one of the biggest IP licenses out there, which will be heavily and actively protected by a strong legal department.
You've obviously put a lot of work into the project though, so I hope you get a fair run with the app before you get the take down notice.....
I was reading through the fair use a bit. (Awhile back I was compiling lists for video game collectors) Section 107 - 118 of the copyright (specifically section 107) outline what is "considered" fair use. It's always up to the attorneys to present their interpretation so its not always clear. But in your case your app is for collectors to perform research on the variations and identify which ones they may or may not own. I think that your app will fall under that portion of the fair use more easily than any other. Best if you have an attorney review it first just to make sure. But even then a good attorney is going to say that there's always a chance they will fuss about it or get it taken down.
The other route is to call and see if you can get permission and then you can label it as an "Official" guide.
I wasn't looking to write a thesis in the fair use doctrine, so I used a simple example. There are several points of what is considered fair use. We beleive we have complied with all , but anyone can get sued by anyone for anything. There is a similar Lego app for figures, a Star Wars book app, countless Star Wars websites and a SW reference app we published on iTunes a year ago. All are not authorized by Lucas. Hopefully we stay under the radar and won't get the sharp saber of Disney, but we don't think we are violating any copyrights or trademarks.
Now our next app Luke Skywalker's Angry Birds Doodle Jump might have a legal issue or 2.
I used to have a few figures and what not when I was younger and still have boba fetts slave 1 ships in my office the one with the frozen hans solo in the back :P

Or Disney's, didn't he sell the rights to them?
