Can't email the guy, as there's no address on his website. As far as I could tell, he gave out the source code so others could learn from it. I'm sure he didn't intend for it to be sold by someone else for $2 a pop...

hey people ... why don't you ask one of the admins to ask him to take the game off the store or else they will ban the account so that he will not be able to create any other games?? there must be another solution.... ill do some research.
Does this guy only steal GS games where the code is available for download? I know that you can steal the code anyway if you have some web knowledge but if it turns out that he only goes for "available" code, the problem isn't that big. We just don't share our code in the traditional way then.

His modus operandi should automatically prevent him from having an account here, full stop. If the allegations can be proven, and I'm sure Gendai can easily do that, his account should be suspended permanently. This type of person is not welcome in our brotherhood. I mean, his intentions are very clear, aren't they?
Of course he will simply open another account but it will cost him another $99 or so.

hmm... i think what has happened is totally legal because of the "Terms of Use" of GS... We have had a lot of discussions because of these "terms" earlier ... and while GG has changed their terms of use for the "iphone-Service" ... loading up your game to the public still means that you give away ALL(!) your rights...
Well ... i would change the images in the game and would upload your game to the appstore too... plus inform the owner of the copyrights of the original images...
You know... just because you have shared your rights with this nice guy, doesn't mean that you don't own these rights too! So you can stil publish the game on your own name or publish 100 slightly different versions of it... to make the market for this game a little smaller
SDMG is right, on the bright side, if you aren't successful then simply polish up the game, make it look all snazzy, make it easier for people to find and just make it look a whole lot better than his copy. You can still make sales.

I contacted apple but im waiting for a responce.My whole intention on sharing my game was so that people can get some help from it. it was my first game so it took me a long time to learn all this stuff so it being completely stolen without any changes and is now being sold makes me angry. Im glad the pictures were copyright so if apple doesnt do anything then ill contact the owners of the pictures. The reason why i didnt publish it was because of the pictures but the guy didnt seem to mind...TYPICAL
okay so i can change the copyright images to my images and then publish it. After its published then i can try my best to take off the game itechtouch stole...Would that work out..??thks
iWin... sorry this happenned to you (and others)... some other developpers and similar problems with their games being cloned even if they weren't using Gamesalad, and their app almost had similar name and they put them up for free.
Why? They know that the app they cloned was in the top list, and when they put up the free version it just got them a lot of visibility... for their other games. I don't know if that really helped them make more money in the end, and even if Apple had removed the cloned app... but there are probably more and more of these stories nowadays. Similar games, other prices, just a theme change.. thing is i don't think Apple cares at all how the market behaves.. they approve or not based on weird criterias (and maybe even the mood of the guy how validates) and let the people complain .... they hold the developpers by the b@lls
Think of it this way... you can't sell more than so many apps on your own (using ad-hoc distribution), otherwise you have to be on the market and be at the mercy of copies, reviews (bad or good) approval, competition
So maybe to have less chances of being copied no publish to the web ??!? Then at least someone has to work to copy the concept.
Don't worry though... try and send your game anyways after you make it legal.. keep on trying to have his game removed... send in bad reviews in his game, we'll put good ones on yours. Use marketing tricks
That really sucks! Don't ever post your game up for other people to download, especially if you haven't already submitted it! What a nightmare, this person should be banned though as it goes without saying that you don't take someone else's game, and sell it in the App store!

When i understand the above terms of use right... than its you who grant every user of your shared game that you own all copyrights of the images you have used and you share these rights with all of us by publishing your game to GS.
That could mean that itechtouch is allowed to use the images and your game and if anyone complains about the copyrights it could be you who pay the rent (?) because you have granted to own these rights (the images too)... and you have shared these rights with us...

Yeah i guess i had to learn the hard way. Since it was my first game i got a lot help from the shared folder so i thought it would of been fair if i could show others how to do stuff that they didnt know but some took advantage and are making money off it. Im almost done with my 2nd game which i know not to publish to the web but directly to the iphone..We havent came to a conlusion by the name is probably going to be "Mighty Meo". it has like 30 scenes.Lol..lets see if he can copy this game that untalented prick..
After learning the images were copyright images i took it off and made it visible for only me. In that one day time he was able to take it and publish it right away. This is so unfair because i was just using the images to test a game not to make any kind of profit out of it. It was my first game so i had no idea what to do or what i can use. I wanted to research more before i published it but i was too late. Plus its not like that game is going to be a top hit so its unlikely the owners of the pictures would sue. They would demand it taken off.. RIGHT??
I was always a little leery about having my game out for everyone to view. The only game I did load up to GS I set for me to view only about two months ago. I did share my game with mulchay, but he was a established user of GS (and he was trying to help me).
I do hope GS removes this users and Apple takes his/her games off.
